Welcome to the website of Ozzy’s Rescue and Sanctuary (“Ozzy’s Rescue,” “we,” “us,” or “our”). These Terms and Conditions govern your access to and use of www.ozzysrescueandsanctuary.org, and any webpages, forms, applications, donation portals, online services, or other digital resources operated by or on behalf of Ozzy’s Rescue and Sanctuary (collectively, the “Website”).
Please read these Terms and Conditions carefully. By accessing or using the Website, submitting information through the Website, making a donation, or using any Website service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions and our Privacy Policy.
If you do not agree with these Terms and Conditions, please do not use the Website.
1. About Ozzy’s Rescue and Sanctuary
Ozzy’s Rescue and Sanctuary is a California nonprofit public-benefit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code.
Our mission includes rescuing, protecting, rehabilitating, supporting, and finding appropriate placements for animals in need. We may also provide educational, community-support, volunteer, foster, adoption, sanctuary, and animal-welfare programs consistent with our charitable mission.
Information presented on the Website is provided for general informational, educational, charitable, and community-engagement purposes.
2. Eligibility to Use the Website
The Website is intended for users who are at least 18 years old.
Individuals under 18 may view general Website content with the involvement and permission of a parent or legal guardian. Minors may not independently:
Submit an adoption or foster application;
Enter into a volunteer or program agreement;
Make a legally binding commitment;
Create an account requiring contractual consent; or
Submit payment information without permission from a parent or legal guardian.
Some youth programs may be available with prior written consent from a parent or legal guardian and subject to separate program requirements.
By using the Website or submitting an application, you represent that you are legally capable of entering into a binding agreement or that you have the authorization and supervision required by law.
3. Permitted Use
You may use the Website only for lawful, personal, and noncommercial purposes consistent with the mission of Ozzy’s Rescue and Sanctuary.
You agree not to:
Use the Website in violation of any applicable law or regulation;
Submit false, misleading, fraudulent, or incomplete information;
Impersonate another person or misrepresent your identity or affiliation;
Attempt to gain unauthorized access to the Website, its servers, accounts, or databases;
Introduce malware, viruses, harmful code, automated scraping tools, or disruptive technology;
Interfere with the operation, security, or availability of the Website;
Collect personal information about another user without authorization;
Use animal photographs, descriptions, or other Website content to misrepresent an animal’s availability, ownership, location, or status;
Use the Website to sell, transfer, breed, exploit, harm, or unlawfully obtain an animal;
Harass, threaten, defame, or abuse our employees, volunteers, applicants, supporters, partners, or other Website users; or
Use our name, logo, content, or goodwill for unauthorized fundraising, commercial activity, solicitation, or endorsement.
We may restrict, suspend, or terminate access to the Website when we reasonably believe a person has violated these Terms and Conditions, created a safety risk, engaged in fraudulent or abusive conduct, or acted contrary to our charitable mission.
4. Animal Profiles and Availability
Animal profiles, photographs, descriptions, behavioral observations, medical information, and availability status are provided in good faith based on information reasonably available to us at the time of publication.
Animals are living beings whose health, behavior, needs, temperament, and availability may change. We do not guarantee that:
An animal displayed on the Website remains available;
An animal will be appropriate for a particular household;
An animal will possess every characteristic described in a profile;
An animal’s breed, age, weight, medical history, or behavioral history is complete or exact;
An applicant will be approved to adopt or foster an animal; or
An approved applicant will be matched with the animal originally requested.
Breed identifications may be visual estimates unless genetic testing or reliable documentation is available. Information supplied by shelters, previous guardians, veterinarians, foster providers, or other third parties may not always be complete.
Material information known to Ozzy’s Rescue will be disclosed as required by applicable law and our placement procedures.
5. Adoption Applications
Submitting an adoption application does not guarantee approval, reserve an animal, establish ownership, or create a binding adoption agreement.
Adoption decisions are based on the individual animal’s health, safety, behavioral needs, living requirements, and long-term welfare. Relevant considerations may include the applicant’s household, experience, landlord approval, existing animals, family members, location, veterinary history, ability to provide care, and other placement factors.
Ozzy’s Rescue reserves the right, to the extent permitted by law, to:
Request additional information;
Verify application information and references;
Contact landlords, veterinarians, household members, or other references identified by an applicant;
Conduct interviews, meetings, or home-safety evaluations;
Require introductions between an animal and household members or resident animals;
Decline, pause, or close an application;
Select the applicant and home considered most appropriate for a particular animal; and
Remove an animal from availability at any time.
No adoption is final until all required approvals are completed, a separate adoption agreement is signed, required fees are paid, and possession of the animal is formally transferred.
The separate adoption agreement controls if it conflicts with general information presented on the Website.
6. Foster Applications
Submitting a foster application does not guarantee approval or placement of an animal.
Foster applicants may be required to complete orientation, interviews, reference checks, home-safety evaluations, training, and other screening appropriate to the animal and program.
Animals placed in foster care remain under the ownership or legal control specified in the applicable foster agreement. A foster provider may not sell, give away, relocate, breed, transfer, surrender, euthanize, or permanently place a foster animal without prior authorization from Ozzy’s Rescue, except when emergency veterinary care is authorized under the applicable foster agreement or required by law.
All foster placements are governed by a separate written foster agreement. That agreement controls if it conflicts with these Website Terms and Conditions.
7. Volunteer and Program Applications
Submitting a volunteer, partnership, educational-program, community-program, or other application does not guarantee acceptance or participation.
Participation may require:
An interview or orientation;
Training or supervision;
Proof of age;
Parental or guardian consent;
A background check when legally appropriate;
A confidentiality agreement;
A liability release;
Compliance with health and safety rules; or
Execution of a separate volunteer or program agreement.
Ozzy’s Rescue may modify, suspend, restrict, or end participation when reasonably necessary for animal welfare, human safety, confidentiality, operational integrity, or compliance with law.
8. Donations
Donations support the charitable mission and programs of Ozzy’s Rescue and Sanctuary.
Unless a specific written restriction is expressly accepted by an authorized representative of Ozzy’s Rescue, donations are treated as unrestricted and may be used where needed most in furtherance of our charitable purposes.
A donor’s stated preference, dedication, memorial designation, campaign selection, sponsored-animal designation, or accompanying message will be honored when reasonably possible but does not necessarily create a legally restricted gift. If a particular program, campaign, project, or animal no longer requires funding, becomes unavailable, or cannot use all designated funds, Ozzy’s Rescue may redirect the funds to a related charitable purpose or another area of greatest need, to the extent permitted by law.
Donations are generally nonrefundable. If you believe a donation was made in error, duplicated, unauthorized, or entered for an incorrect amount, contact us promptly. Refund requests will be evaluated individually and remain subject to applicable law, payment-processor requirements, and the circumstances of the transaction.
Donation acknowledgments are provided for recordkeeping purposes. Donors are responsible for consulting their own tax advisers regarding deductibility and individual tax consequences. No statement on the Website constitutes tax, accounting, or legal advice.
Unless expressly stated otherwise, donations do not purchase ownership, custody, visitation rights, decision-making authority, or any other legal interest in a particular animal.
9. Recurring Donations
If you authorize a recurring donation, you authorize our payment processor to charge the selected payment method at the frequency and amount shown during enrollment until the recurring donation is canceled or modified.
You are responsible for maintaining accurate payment information.
Cancellation or modification requests should be submitted before the next scheduled processing date. A request received after processing has begun may not take effect until the following billing cycle.
The Website or third-party payment processor may provide instructions for managing recurring donations. Ozzy’s Rescue may also discontinue a recurring donation arrangement if payment cannot be processed or the program changes.
10. Fundraising Campaigns and Sponsorships
The Website may offer fundraising campaigns, animal sponsorships, memorial giving, tribute giving, wish lists, matching campaigns, or other charitable opportunities.
Unless otherwise stated in a separate written agreement:
Sponsorship does not create legal ownership or custody of an animal;
Sponsorship does not guarantee that a particular animal will remain at the sanctuary;
Sponsored animals may be adopted, transferred, placed in foster care, receive outside treatment, or experience changes in medical or behavioral status;
Campaign descriptions and projected costs are estimates and may change; and
Funds may be applied to related animal-care or charitable needs when the original purpose has been fulfilled, becomes impracticable, or is adequately funded.
The use of an animal’s name or story in a campaign does not convert the contribution into a purchase or payment for services.
11. Purchases and Merchandise
If merchandise, event registrations, program materials, or other products are offered through the Website, additional terms concerning prices, payment, taxes, fulfillment, shipping, returns, refunds, preorders, or cancellations may appear during checkout or on the applicable product page.
Prices and availability may change without notice. We reserve the right to correct typographical errors, pricing errors, product descriptions, availability information, or transaction errors.
A payment confirmation does not necessarily constitute acceptance of an order. We may cancel or limit an order because of product availability, suspected fraud, pricing errors, legal restrictions, or other reasonable operational concerns. When appropriate, amounts paid for a canceled order will be refunded.
Unless expressly stated otherwise, purchases of merchandise are not tax-deductible to the extent the purchaser receives goods or services in return. Any potentially deductible amount depends on applicable law and the value of the goods or services received.
12. Payment Processing
Payments and donations may be processed through independent third-party payment providers. Ozzy’s Rescue does not necessarily receive or retain complete payment-card information.
Your transaction may also be governed by the terms, privacy policies, and security practices of the applicable payment processor, bank, mobile-payment provider, or fundraising platform.
You represent that:
The payment information you provide is accurate;
You are authorized to use the selected payment method; and
You authorize the applicable charges, including recurring charges when selected.
Ozzy’s Rescue is not responsible for delays, declined transactions, processor outages, bank fees, or security incidents occurring entirely within an independent third-party payment system, except to the extent liability cannot legally be excluded.
13. User Accounts
If the Website permits user accounts, you are responsible for:
Providing accurate and current information;
Maintaining the confidentiality of your username and password;
Restricting access to your account and devices; and
Promptly notifying us of suspected unauthorized access.
You are responsible for activity conducted through your account to the extent permitted by law. We may suspend or terminate an account that contains false information, appears compromised, is used improperly, or violates these Terms and Conditions.
14. Information and Materials You Submit
You are responsible for information, photographs, documents, comments, testimonials, stories, messages, and other materials you submit through the Website.
You represent that:
The submission is accurate to the best of your knowledge;
You have the right and authority to submit it;
It does not violate another person’s privacy, publicity, contractual, intellectual-property, or other legal rights;
It is not unlawful, threatening, defamatory, fraudulent, obscene, abusive, or malicious; and
It does not contain malware or harmful code.
Submitting an application or form authorizes us to use the information for evaluating and administering the applicable request, program, donation, inquiry, or relationship, as described in our Privacy Policy.
If you voluntarily submit a testimonial, animal story, review, photograph, video, or other promotional material, you grant Ozzy’s Rescue a nonexclusive, royalty-free license to review, store, reproduce, and use that material for the purpose for which it was submitted, subject to applicable law and any separate written release.
We will not treat sensitive personal information submitted through a designated application or contact form as public promotional content merely because it was submitted through the Website.
15. Privacy
Our collection, use, storage, and disclosure of personal information are addressed in our Privacy Policy, which is incorporated into these Terms and Conditions by reference.
Do not submit highly sensitive information through a general contact form unless the form specifically requests it. Sensitive documents should be transmitted only through an approved secure method.
16. Intellectual Property
Unless otherwise stated, the Website and its content, including text, photographs, animal profiles, graphics, illustrations, videos, audio, logos, designs, page layouts, downloadable materials, program names, slogans, and other content, are owned by or licensed to Ozzy’s Rescue and Sanctuary and are protected by applicable copyright, trademark, and other intellectual-property laws.
The names Ozzy’s Rescue and Sanctuary, Ozzy’s Rescue, associated logos, and “Rescuing the Rescuers™” may not be used in a manner that suggests sponsorship, endorsement, partnership, affiliation, fundraising authorization, or approval without prior written permission.
You may view and print reasonable portions of the Website for personal, noncommercial use. You may not, without prior written authorization:
Reproduce or republish substantial Website content;
Modify, sell, license, distribute, or commercially exploit Website content;
Remove copyright, trademark, attribution, or ownership notices;
Use animal photographs or stories for unauthorized fundraising or advertising;
Create misleading social-media accounts, websites, campaigns, or merchandise using our identity; or
Use our content to train, populate, or commercially operate an unrelated database, application, or service.
17. Third-Party Websites and Services
The Website may contain links to or integrations with third-party websites and services, including:
Payment processors;
Shopping or wish-list platforms;
Social-media services;
Mapping services;
Animal adoption platforms;

Email and communication providers;
Event-registration platforms;
Veterinary, shelter, rescue, government, or community resources; and

Ozzy’s Rescue does not control and is not responsible for the availability, security, accuracy, accessibility, content, products, services, or privacy practices of independent third parties. Your use of a third-party service is governed by that third party’s terms and policies.
18. No Veterinary, Medical, Mental-Health, Legal, or Professional Advice
Website content is general information and does not constitute veterinary, medical, mental-health, legal, financial, tax, or other professional advice.
Information about animal health, behavior, training, nutrition, safety, or care is not a substitute for evaluation and advice from a qualified veterinarian, certified professional, licensed trainer, animal behavior professional, attorney, accountant, or other appropriate adviser.
Ozzy’s Rescue does not provide emergency veterinary services through the Website.
If an animal is experiencing a medical emergency, contact a licensed veterinarian or emergency veterinary hospital immediately. If a person is experiencing a medical or mental-health emergency, call 911 or contact the appropriate emergency service.
19. The Healing Pack Initiative and Related Programs
Information concerning The Healing Pack Initiative or other human-support programs is provided for general educational and program-description purposes.
Unless expressly stated in a separate written agreement, Ozzy’s Rescue and Sanctuary:
Is not a hospital, detoxification facility, residential treatment center, medical provider, or emergency mental-health provider;
Does not provide on-site medical detoxification;
Does not diagnose or treat substance-use disorders or medical or psychiatric conditions;
Does not replace licensed treatment providers or emergency services; and
Does not guarantee any medical, therapeutic, recovery, behavioral, or personal outcome.
Eligibility, referrals, participation requirements, supervision, releases, confidentiality provisions, and program limitations may be governed by separate written policies or agreements.
20. Website Information and Availability
We make reasonable efforts to provide accurate and current information, but Website content may contain errors, omissions, outdated information, or technical problems.
We do not guarantee that:
The Website will always be available, uninterrupted, or error-free;
Website content will always be complete, accurate, or current;
Every message, application, or submission will be received;
Technical problems will be corrected immediately; or
The Website will be free of viruses, harmful code, or security vulnerabilities.
We may change, remove, suspend, or discontinue any Website feature, animal profile, program description, application, campaign, product, or service at any time.
For time-sensitive animal-welfare or safety matters, do not rely exclusively on email, social media, or a Website form.
21. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.
Ozzy’s Rescue disclaims, to the fullest extent legally permitted, implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security.
Nothing in these Terms excludes any warranty or right that cannot legally be excluded under applicable law.
22. Limitation of Liability
To the fullest extent permitted by law, Ozzy’s Rescue and Sanctuary and its directors, officers, employees, volunteers, agents, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:
Use of or inability to use the Website;
Reliance on Website information;
Loss of data;
Third-party websites or services;
Unauthorized access to information;
Technical failures or interruptions; or
Website-based applications, inquiries, donations, or transactions.
These limitations apply only to Website-related matters and do not replace or alter the terms of a separately executed adoption, foster, volunteer, program, event, purchase, or other agreement.
Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.
Nothing in these Terms is intended to exclude liability for fraud, willful misconduct, gross negligence, or any liability that cannot legally be limited or excluded.
23. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Ozzy’s Rescue and Sanctuary and its directors, officers, employees, volunteers, agents, and representatives from third-party claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:
Your unlawful or unauthorized use of the Website;
Your material violation of these Terms and Conditions;
Information or materials you submit;
Your infringement of another person’s rights; or
Fraudulent, malicious, or intentionally harmful conduct.
This section does not require you to indemnify any party for that party’s own negligence, willful misconduct, or violation of law.
24. Electronic Communications
When you submit a form, create an account, make a donation, register for a program, or communicate with us electronically, you consent to receive transaction-related communications electronically.
Marketing emails and text messages will be sent only in accordance with applicable law and any consent requirements. You may unsubscribe from promotional emails using the unsubscribe link provided in those communications.
Unsubscribing from promotional communications may not prevent us from sending necessary transaction, donation, application, safety, program, or legal notices.
25. Changes to These Terms
We may update these Terms and Conditions as our Website, programs, operations, or legal obligations change.
The updated version will be posted on the Website with a revised “Last Updated” date. Material changes may also be communicated through an additional Website notice when appropriate.
Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law. Changes will not retroactively alter a separately signed agreement unless that agreement permits such a change.
26. Governing Law and Venue
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict-of-law principles.
To the extent legally permitted, any legal proceeding arising exclusively from use of the Website or these Terms shall be brought in a state or federal court having jurisdiction in Ventura County, California.
This provision does not prevent either party from seeking appropriate relief in another jurisdiction when required by law, nor does it override mandatory consumer-protection rights.
27. Dispute Resolution
Before filing a legal claim concerning the Website, the parties are encouraged to attempt to resolve the matter through good-faith written communication.
A written notice should describe:
The person submitting the concern;
The relevant Website activity or transaction;
The nature of the dispute;
Supporting information; and
The requested resolution.
Nothing in this section prevents a person from contacting a government agency, reporting suspected unlawful conduct, seeking emergency relief, or exercising a right that cannot legally be waived.
28. Severability
If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.
29. No Waiver
A failure by Ozzy’s Rescue to enforce any provision of these Terms and Conditions does not waive that provision or the right to enforce it later.
30. Entire Agreement and Separate Agreements
These Terms and Conditions, together with the Privacy Policy and any notices expressly incorporated by reference, constitute the agreement governing general use of the Website.
Adoption, foster, volunteer, employment, contractor, partnership, sponsorship, event, program, purchase, and other activities may require separate written agreements.
If a separately signed agreement conflicts with these Website Terms and Conditions, the separately signed agreement controls with respect to its specific subject matter.
31. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Ozzy’s Rescue may assign these Terms in connection with a lawful organizational restructuring, succession, transfer of Website operations, or similar transaction consistent with applicable nonprofit law.
